Rawat government passes transfer act in Gairsain Winter assembly session

Trivendra Singh Rawat led BJP government today passed the Transfer Act in the Winter Assembly session at Gairsain, which concluded today. After the transfer act is implemented, the first appointment and promotion in the state will be essentially in inaccessible areas. In order to be eligible for the first and second promotions, employees must have served atleast half the amount of time as required under the minimum qualifying service guidelines. This system though will be fully effective from July 1, 2020.

It has been made in the transfer bill that after considering the transition period from the date of implementation of the transfer act to 30 June, 2020, in the event of promotion in this period, if the person has not spent half of this time in an inaccessible place, It will be necessary that he/she will be deployed in an inaccessible place till completion of the said period. Those personnel who have not been deployed in the inaccessible period of their service, can apply for a transfer based on the request in the inaccessible area for the eligibility of the promotion.

Incentive benefits in inaccessible deployment under Transfer Act of Uttarakhand

Arrangements have been made to provide incentive benefits for personnel posted in remote areas. If such personnel are deployed at more than 7,000 feet in an inaccessible place, then one year service period will be treated as a two year facility. One year service of personnel posted in remote in less than seven thousand feet, will be treated as one year and three months service.

The HOD will decide the transfer of Group- B officials, on the basis of recommendation of the committee constituted for the transfer of Group’s officials, while the administration will decide the transfer of Group A officials.

Exempt on the provisions of the Transfer Act is possible

In case of difficulty in implementing the transfer act, the Committee constituted under the chairmanship of the Chief Secretary on the exemption of the provisions of the Act will consider the issues. The Committee will send its recommendation to the Chief Minister for approval for relaxation. After this, the state government can make necessary rules.

These are transfer schedules

Schedule has been set for transfers. According to this, the transfer orders of personnel will continue till June 10. The transferred personnel must be deemed free within ten days of the transfer order and will have to report to new place within ten days. The State Government will have the right to change in schedule.

Each year, the Head of the Office and the Head of the Department will make the marking according to the standard of workplace and the inaccessible work place till March 31, whereas till 1 April, the transfer committees will be constituted by the Head of the departments, the governance, divisional and district levels. Release of vacancies of eligible personnel for accessible and inaccessible transfers and publication on website will be till April 15.

The date for requesting applications for 10 desired locations is April 20 and the date for seeking application based on request has been fixed on April 30. The duration of the meeting and recommendation of the transfer committee will be from May 25 to June 5. Within two days of the transfer order, they will be displayed on the website.
