Female government employees to get maternity leave for third child also rules Uttarakhand High Court

Uttarakhand High Court has come out in the defense of a women government employee saying that the government rule prohibiting maternity leave for a third child is unconstitutional. The woman employee was refused maternity leave for her third child.

Judge Rajiv Sharma’s single bench while hearing the writ petition filed by Urmila Manish, who is from Haldwani, said that refusing to give maternity leave to her third child is against the spirit of the Constitution. In the second provision of financial rule 153 of Uttar Pradesh fundamental rules adopted by Uttarakhand, a female government employee had been denied maternity leave for third child.

The court said in its verdict on July 30 that the rule should be abolished, as it is against Article 42 of the Constitution and Section 27 of the Maternity Benefit Act, 1961, which provides correct and human condition and maternity relief for work. Adopting a humanistic view on this, the court said in its judgment that the petitioner should be given this leave. Urmila was denied her maternity leave on the basis that she already had two children and she can not be given a break for the third child.
