CoA lifts ban on Hardik Pandya & KL Rahul

Ban lifted with immediate effect

In the matter of making objectionable comments on women in television program by Indian cricket team player Hardik Pandya and KL Rahul, the administrators’ committee (CoA) has lifted the suspension. However, the investigations against both will continue. Before that, CoA chief Vinod Rai had said that instead of endangering the career of the two players, the BCCI should focus on improving them. BCC’s acting president, CK Khanna had earlier said that the suspension should be removed on both and investigation should continue. Although, despite the unconditional apology of both the players, BCCI’s 10 units had demanded to convene a special general meeting to appoint a Lokpal to investigate the matter.

Hardy Pandya’s comments were criticized during the TV show Koffee with Karan, and they were termed as sexists. Pandya later apologized. He had said that he was swept away by feelings during the show. In this show, Rahul was also with Pandya. On behalf of the CoA appointed by the Supreme Court, Pandya and Rahul have were sent a show-cause notice and given 24 hours of time for clarification. After unwarranted comment against women on TV shows, CoA chief Vinod Rai had recommended the ban of two matches on both the players.

Edulji, another member of the CoA, initially suggested to suspend both of these for two matches but later sent the matter to the legal department. CoA member Diana Edulji had recommended suspension till further action against Indian players Pandya and Lokesh Rahul, as the legal team of the BCCI refused to declare it violation of code of conduct. After taking legal opinion from the legal team, Edulji had said in its response that it is necessary that both the players should be suspended till the decision on the action of misbehavior (as was done in the case of BCCI CEO Rahul Johri, when in the sexual harassment matter, he was sent on leave).

The law firm has clarified that inappropriate comments of Pandya do not come under the purview of the code of conduct. According to legal opinion, ‘We believe that the present case does not come under the purview of the Code of Conduct and in the current situation the code of conduct can not be implemented. A senior BCCI official, while supporting the vision of Edulji, said that suspension should be done until the investigation is pending. He said that it is not a case of code of conduct but harm to the reputation of the institution. As the ICC banned Australian Steve Smith for 1 year under the code of conduct in the allegations of ball tampering.
