Haldwani Encroachment Case: Supreme Court stays High Court decision

Supreme has  granted stay on removal of over 4000 families in Banbhoolpura of Haldwani. The Supreme Court has issued a notice to the Uttarakhand government and the Railways in this matter, seeking answers. The next hearing of the case will be on February 7. The Supreme Court also questioned the order to remove the encroachment within seven days. The court said that the human aspect also has to be kept in mind in this matter. With the order of the court, more than 50 thousand people have got immediate relief.

The Supreme Court stayed the High Court order to remove encroachment from railway land in Banbhoolpura area of Haldwani. The date of February 7 was fixed for the hearing of the case. The court said during the debate that it is a humanitarian matter. There is a need to find some practical solution in this matter.

Notice to Uttarakhand Government, Railways

A petition was filed in the Supreme Court against the decision of Uttarakhand. The Supreme Court has issued a notice to the Government of Uttarakhand and the Indian Railways seeking answers. Advocate Lubna Naz told that the Supreme Court said during the hearing that no construction would be done on that land. Rehabilitation planning should be taken into account. Schools, colleges and others are solid structures, which cannot be demolished like this.

The High Court had given the order to remove the encroachment

Railway claims that it has illegal occupation of 78 acres of land. 4365 kutcha-pucca houses have been built on railway land. On December 20, the High Court had ordered the removal of illegal encroachments on railway land.
