SC stays anti-encroachment demolition drive in Jahangirpuri for 2 weeks

Hearing was held in the Supreme Court today against the action of the North Delhi Municipal Corporation on anti-encroachment drive in Jahangirpuri. During the hearing, lawyers for both the sides gave their respective arguments. After hearing the arguments, the Supreme Court asked to maintain status quo for the time being and not to take any action in Jahangirpuri till further orders. The court also made it clear that this order is only for Jahangirpuri and not for other parts of the country. At the same time, the next hearing of this case will now take place after two weeks. Special community being targeted under the guise of removing encroachment: Sibal

Kapil Sibal also argued in the case that encroachment and illegal construction is the problem of the whole country. But under its guise they are targeting a community.

Action continued even after court order: Dave

Senior advocate Dushyant Dave, who has filed a petition in the Supreme Court against the removal of encroachments in Jahangirpuri, said that the matter raises far-reaching questions of constitutional and national importance. He also said that this matter is not limited to Jahangirpuri, if it is allowed then the rule of law will not survive. Dave told that the demolition process had started at 9 in the morning and the action continued even after the order of the court. On being asked by the court, advocate Dave said that ‘5 to 15 days notice under section 343 to remove the encroachment should have met. In such cases, many times the court has extended the period of notice. People cannot be removed without notice. This is a violation of his Right to Life.’

Do not do any demolition drive for two weeks: Court

After hearing all the arguments, the court has said that we will now hear the matter after two weeks and till then the status quo will have to be maintained in Jahangirpuri. The court also made it clear that his order is only for Jahangirpuri and not for other parts of the country. If by then the corporation takes any action in Jahangirpuri, it will be taken seriously by the court and it will be treated as contempt.
