Senior congress leader says ‘constitutional crisis’ in Uttarakhand

Senior Congress leader and former minister Nav Prabhat said that a constitutional crisis has arisen in the state. In such a situation, there should be an immediate change of leadership in the state government. In a statement on Sunday, former minister Nav Prabhat said that Chief Minister Tirath Singh Rawat is no longer an MLA. To continue as the Chief Minister, he has to win the election and become a member of the Legislative Assembly within six months. This deadline expires on September 9.

He said that, according to section 151A of the Representation of the People Act, when one year is left for the assembly elections in a state, then bye-elections cannot be held there. At present two assembly seats are vacant in the state. Assembly elections are proposed in March 2022. In such a situation, Tirath Singh Rawat cannot continue on the post of Chief Minister after September. Under these circumstances, a constitutional crisis has arisen in the state and a change of leadership is needed in the government.

Earlier in the legislature party meeting, all the MLAs had unanimously elected Tirath Singh Rawat as their leader. Congress leader Navprabhat said that TS Rawat, who is not an MLA at present but is the Chief Minister, needs to be elected to the Assembly within 6 months of assuming the office of CM. Bye-elections cannot be held if years are left. Therefore, in such a situation, Uttarakhand BJP may have to change the Chief Minister once again.
