Lower PCS Mains Exam 2022: High Court rules in favor of students

The High Court heard the petition filed by the Public Service Commission against the removal of 12 questions from the preliminary examination of Uttarakhand Combined State (Civil) Lower Subordinate Services Examination (Lower PCS) 2021.

After hearing the matter, a single bench of Justice Manoj Kumar Tiwari has directed the Public Service Commission to allow the petitioners to appear in the Main examination of Lower PCS, the court has asked the commission to submit its reply within three weeks.

Ramnagar resident Pawan Nainwal, Vikas Sharma and 55 others had filed a petition saying that the preliminary examination of Lower PCS was conducted by the State Public Service Commission in February 2021, experts of the commission declared 12 correct questions wrong and 12 bonus marks were given to the candidates. Due to which hundreds of candidates who gave correct answers to those 12 questions failed on the basis of negative marking system and got debarred from Mains exam.

So they had filed a petition that they should be allowed to appear in the Mains exam. The petitioner’s advocate Dushyant Mainali also told the court that due to this decision of the commission, these candidates were left out of the merit list. They got these questions right. Those who had less marks or who did not attempt these questions, they came up in the merit list. The last date for filling the form of Mains examination has been kept by the commission on 25 March. The exam is to be held in August. Therefore, they should be allowed to appear in the Mains examination.

All these 57 students, who were denied the examination, won the battle against the commission on Tuesday. The High Court has directed the students to appear in the Mains examination. The matter was heard in the single bench of Justice Manoj Kumar Tiwari. The court has also asked the commission to submit its reply in this matter in two weeks.
