Rahul Gandhi disqualified as Lok Sabha MP

Rahul Gandhi’s membership of Parliament has been terminated. The Surat court had sentenced him to two years’ imprisonment yesterday. Although he had gotten bail for it the same day. A notification regarding his disqualification has been issued by the Lok Sabha Secretariat. In the case of defamation, the court of Surat had sentenced Rahul Gandhi to two years imprisonment on Thursday itself. Rahul Gandhi was accused of controversial remarks regarding the ‘Modi’ surname during the 2019 Lok Sabha elections. Against whom Gujarat BJP MLA Purnesh Modi had filed a defamation case against Rahul.

Notification issued by the Lok Sabha Secretariat

A notification of seven lines has been issued in this regard by the Lok Sabha Secretariat. It states that Rahul Gandhi, Lok Sabha member from Wayanad, Kerala, is disqualified from the membership of the Lok Sabha after being convicted by the Court of Chief Judicial Magistrate, Surat. This disqualification will be applicable from the day of his conviction i.e. March 23, 2023. This decision has been taken under the provisions of Article 102 (1) (e) of the Constitution and Section 8 of the Representation of the People Act, 1951.

 

What is law?

According to the Representation of the People Act, if any MP or MLA is sentenced to two or more years in any case, then their membership will be cancelled. Also, they become ineligible to contest elections for six years. In such a situation, if Rahul Gandhi does not get relief from the upper court, then he will not be able to contest the 2024 Lok Sabha elections, which will be a big blow for him and Congress.
